Appellate Immigration Litigation (2-15-24)

Legal Services NYC and Central American Legal Assistance are proud to present this training on litigating immigration claims at the appellate level. In this training, the instructors will focus on how to preserve issues for appeal, starting from early client contacts, through preliminary hearings, through the merits hearing, and all the way up to Circuit Court litigation. We’ll cover some trial advocacy and preparation skills with an emphasis on issue preservation, the nuts and bolts of appeals, analyzing Immigration Judges’ decisions, brief writing, Petitions for Review, and oral argument at the Circuit Court.

About the Faculty

    Rebecca Press (Speaker)

    Rebecca Press (She/Her) is UnLocal’s Legal Director, leading the Legal Team in providing representation to New York’s immigrant communities, including those at imminent risk of deportation, those fleeing persecution, the long-time undocumented, and many others. Rebecca has over ten years of experience representing immigrants of all ages in removal proceedings, with a particular focus in Asylum and Protection under the Convention Against Torture. She practices regularly before the Immigration Court, Board of Immigration Appeals, and Federal Court of Appeals for the Second Circuit. In addition, Rebecca clerked at the New York Immigration Court through the Attorney General’s Department of Justice Honors Program. Prior to joining UnLocal, Rebecca was Supervising Attorney at Central American Legal Assistance and at The Legal Aid Society, and a Chadbourne and Parke Fellow at The Door’s Legal Services Center. Before law school, Rebecca worked as a paralegal at Safe Horizon Immigration Law Project and the New York Association for New Americans.

    Dave Wilkins (Speaker)

    Dave Wilkins (he, him) is the Director of Immigration and LGBTQ/HIV+ Advocacy at Staten Island Legal Services. Before joining Legal Services NYC, he was an Asylum Officer at the Newark Asylum Office. He was an Immigrant Justice Corps Fellow and a Staff Attorney at Central American Legal Assistance in Brooklyn, where his practice focused on representing Central American asylum seekers in removal proceedings. He received his JD from Georgetown University Law Center, where he was an advocate in and research assistant for the Center for Applied Legal Studies clinic and received a certificate in Refugees and Humanitarian Emergencies.
