Noncitizen Eligibility for Public Benefits

A common misconception persists: only lawful permanent residents and U.S. citizens are eligible for public benefits. In this course, advocates will learn about the expansive categories of noncitizens who are eligible in New York for cash public assistance, SNAP, and Medicaid. We will explore different ways of screening and intake to ensure that you have adequate information on “immigration status” from a public benefits perspective.

- Identify noncitizens who are eligible for cash assistance, SNAP, and Medicaid

- Learn how to use resources to identify eligibility

- Examine the “public charge” doctrine

About the Faculty

    Jack Newton (Speaker)

    Jack Newton (he, him, el) is the Director of Public Benefits & LGBTQ Advocacy at Bronx Legal Services. Jack co-authored the chapter entitled, "Public Assistance and Housing: Navigating Difficult Benefits Systems," in the Lawyer's Manual on Domestic Violence: Representing the Victim (6th ed., 2014). Prior to joining LSNYC, Jack worked at The Legal Aid Society in family, immigration, benefits, and housing matters. He was a member of the FEPS litigation team and counsel in Pena v. Doar and Velez v. Roberts. Jack earned his law degree from the University of Texas and a Master's of Social Work from Columbia University.

    Marie Vaz (Speaker)

    Marie (she, her) is a Supervising Attorney in the Public Benefits and LGBTQ+ Advocacy Unit at Bronx Legal Services. The Public Benefits practice is focused on providing legal services to vulnerable low-income Bronx residents who need assistance obtaining, retaining, or increasing vital government benefits such as cash welfare, rental subsidies, WIC, and SNAP as well as public health insurance such as Medicare and Medicaid and home care services. The LGBTQ+ Advocacy practice provides comprehensive legal services to low-income LGBTQ+ people along an array of civil legal issues, such as immigration, divorce and custody and name changes. Prior to joining Bronx Legal Services in 2017, Marie was a Staff Attorney at NYLAG specializing in Medicaid and Medicare eligibility and services, emphasizing the needs of low-income people seeking long term care. She has also represented and coordinated services for children with severe medical conditions and/or developmental disabilities as a care manager at SKIP of New York. Marie graduated from Fordham Law School in 2011 as a Stein Scholar in Public Interest Law and Ethics and from Emory University in 2004 with a B.A. in Sociology.
