Creative Litigation Strategies for Pendency and Statute of Limitations Issues in Special Education Law
There have been numerous recent changes in special education law in New York – both in terms of the law itself and in terms of how it is being practiced. This CLE is intended for lawyers that represent the parents of students with disabilities in New York City. The presenters will discuss the black letter law and recent decisions on issues of pendency (or “stay-put”) and the statute of limitations in special education law. The presenters also will discuss creative ways of handling “outlier” cases involving pendency and the statute of limitations. There will be ample time for questions and answers. The goal is for the audience to leave this CLE with a concrete understanding of the law around pendency and the statute of limitations under the IDEA as well as creative ways to litigate those issues.
