Rent Arrears and Consumer Debt Collection in New York City Civil Courts
While many housing cases take place solely for housing court when landlords seek a possessory and money judgment for rent arrears, landlords often commence lawsuits against tenants in Civil Court rather than in Housing Court. This training will focus on situations where a landlord chooses civil court as the forum to seek rent arrears.
In this training, attendees will learn about:
- The procedural differences between Housing Court proceedings and Debt Collection Actions brought in Civil Court
- Common defenses in Civil Court, including the overlap between consumer credit transaction defenses and rent arrears defenses
- Typical rent arrears cases and the challenges they present
- Best practices for interviewing and counseling clients being sued for rent arrears
