Post-Judgment Practice and State of Eviction Proceedings during COVID-19

Since the start of the COVID-19 pandemic up until October 2020, eviction proceedings were largely on hold under the executive and administrative orders, however, landlords are now allowed to request execution of warrants in post-judgment cases by filing DRP-213 motions in “Housing Motion Part”.  As LSNYC represents more and more clients in this posture, this training will provide an overview of relevant statutes and caselaw to defend tenants in post-judgment eviction cases.  This training will offer overview of post-judgment practice involving vacating and staying warrant of eviction, and post-eviction remedies, and tips and best practices in the era of Right to Counsel.   The training will cover changes post-HSTPA and COVID-19 related tenant protections. Attendees will also obtain knowledge about the relevant statutes, executive and administrative orders providing COVID-19 related protections for tenants including the Tenant Safe Harbor Act.

About the Faculty

    Edward Josephson (Speaker)

    Edward Josephson is currently the Director of Litigation at Legal Services NYC and at Brooklyn Legal Services. From 1996-2003, he was the Director of the Housing Law Unit at South Brooklyn. He has defended tenants in eviction proceedings since 1988. Mr. Josephson has litigated a number of affirmative cases on issues of significance to low income New Yorkers, including Grimm v. DHCR, which expanded landlords' liability for rent overcharges; Brooklyn Tenants v. Lynch, a challenge to pro-landlord amendments to the Rent Stabilization Code; Campos v. Rhea and Torres v. Martinez, federal actions that helped reform procedures in the Section 8 rent subsidy program; Frunzescu v. Martinez, which expedited the issuance of emergency Section 8 subsidy transfers; and Lang v. Pataki, a constitutional challenge to laws requiring rent deposits by indigent tenants. He has also litigated numerous cases in federal district and bankruptcy courts to protect the rights of tenants in federally subsidized housing projects. Mr. Josephson is a graduate of NYU Law School.

    George Gardner III (Speaker)

    George C. Gardner III (he, him, él) is a Deputy Director in the Housing Unit of Brooklyn Legal Services. He joined Queens Legal Services as a staff attorney in the Housing Unit in the fall of 2015, then Brooklyn Legal Services in the fall of 2018. Prior to Legal Services NYC, George was a fellow with the Government Misconduct and Racial Justice docket at the Center for Constitutional Rights; an associate in the Complex Commercial Litigation practice at Weil, Gotshal & Manges LLP; and a sole practitioner at The Gardner Law Firm PLLC. George is a graduate of the University of Michigan and Howard University School of Law.
