Ethical Duties Toward Prospective or Current Clients Who Are Minors or Adults With Diminished Capacity
This is an ethics CLE training aimed at civil legal service providers. Note that examples and case studies are drawn from housing and immigration practice. The training will cover ethical considerations when a prospective minor or an adult with diminished seeks out legal representation, and the ethical duties towards the client in the cope of full representation in a legal matter. Case handlers will be provided with ethics rules for reference, presented with best practices, and real fact patterns from practitioners. Participants will apply material learned to two case studies from NYSBA ethics committee. Finally, Participants will be provided with models for assisting clients in making informed decisions about legal matters.
