Proving your Financial Case in Matrimonial Law
Are you a legal services matrimonial advocate and having difficulty seeking a favorable support and/or distributive award? Unsure of how to make an affirmative case for relief with very limited resources? This session will provide legal services matrimonial advocates with legal guidance and practical tips in cases where a suspected, moneyed opposing party has either defaulted or has failed to comply with discovery requests. We’ll cover two situations where defendants are hiding income and/or assets: a) when a defendant has completely defaulted, and b) when a defendant has appeared in court but is not complying with discovery requests, submits vague or incomplete answers, or is non-responsive during depositions. A matrimonial attorney, private investigators, and a forensic accountant will facilitate our discussion and offer three different but interrelated perspectives.
By the conclusion of the training, you’ll learn how to:
- Protect the client if you anticipate a defaulting or uncooperative party;
- Conduct motion practice related to defaults, ‘paper’ discovery, and depositions;
- Find hidden assets;
- Search various record sources, including public records, and locate domestic and international property;
- Compare reported income versus expenses;
- Understand individual and corporate income taxes; and
- Recognize signs of suspicious financial activity in financial records.
