Effective Education Law Advocacy and Immigration Law Developments

Are you an education advocate who has faced increased questions about immigration law following the recent Executive Orders on immigration and actions of U.S. Immigration and Customs Enforcement agents? Unsure of how to best represent students facing suspension in this environment of increased immigration enforcement? Wondering how to advise students and/or their parents who may encounter immigration authorities? In this panel discussion, we will present an overview of the recent Presidential Executive Orders and their possible effects on the legal rights of immigrant students and their parents in New York City. We’ll also discuss how school suspensions and criminal prosecutions may intersect with immigration law and provide an overview of the Department of Education’s policy on law enforcement action at City schools. At the end of the session, participants will learn techniques for effective representation of their clients in light of these federal policies, including best practices in communication with clients and criminal defense attorneys, and will become familiar with the DOE immigration guidance for NYC Schools.

About the Faculty

    Irina Matiychenko (Panel Member)

    Irina, a refugee from the Former Soviet Union, immigrated to the United States in 1992. She is a graduate of the Moscow State University Law School and worked as a criminal defense attorney before coming to the U.S. Irina began working with NYLAG as a volunteer paralegal, coming on board as a full-time paralegal in 1993. Following her graduation from Fordham University School of Law in 1995, she worked at NYLAG as a staff attorney. In 1997, Irina became Coordinator of the Immigration Project, and in 1999, was appointed Director of the Immigrant Protection Unit. In 2013, Irina received a Public Service Award from the New York County Lawyers’ Association (NYCLA).

    Abja Midha (Panel Member)

    Abja Midha is a Project Director at Advocates for Children of New York (AFC). Abja leads AFC’s Immigrant Students’ Rights Project, which works to improve educational opportunities for English Language Learners and immigrant students in New York City public schools.

    Melissa Ruhry (Panel Member)

    Melissa Ruhry is a staff attorney in the Education Advocacy Project at Brooklyn Defender Services, where she addresses the educational needs of young people who are involved in the criminal justice or family welfare systems. A graduate of New York Law School, Melissa was an associate in the Justice Action Center and received the Social Justice Activism Award for her commitment to public interest law and for outstanding contributions to social justice.

    Amy Leipziger (Moderator)

    Amy Leipziger is a senior staff attorney at Queens Legal Services. Her practice includes both Education Law and Social Security Disability Law, and she is dedicated to representing the educational needs of children with special needs and their families. She is the Co-Chair of the Education Law Committee of the New York County Lawyers Bar Association.
