Removal Defense in a Time of Increased Enforcement

This two-hour training will provide an introduction to defending clients who are in removal proceedings.  We will walk through the procedural steps of a removal proceeding, from pleadings at a master calendar through strategy questions at an individual hearing.  We will also discuss common forms of relief including cancellation and (briefly) asylum, withholding and CAT (Convention Against Torture).  We will also give some practical advice on representing clients at removal proceedings, discussing issues of evidence and testimony.

    Victoria Neilson (Speaker)

    Victoria Neilson is the Legal Director of Immigrant Justice Corps, an immigration legal fellowship program that seeks to expand the quality and quantity of immigration legal services. Ms. Neilson has also worked in the Office of Chief Counsel of USCIS, as the legal director of Immigration Equality, and as the legal director of the HIV Law Project. She is an adjunct professor at CUNY School of Law. Ms. Neilson is a member of the Immigration Committee of the New York City Bar Association where she chairs the sub-committee on due process and representation; the New York State Bar Association; and the American Immigration Lawyers Association where she is co-chair of New York's Ethics Committee. She is the editor and co-author of Immigration Law and the Transgender Client, and is a contributing author to AILA's Guide to U.S. Citizenship & Naturalization Law. She is a graduate of CUNY School of Law and Harvard University. She is admitted to the New York Bar.

    Harold Solis (Speaker)

    Harold A. Solis is a Supervising Attorney at Immigrant Justice Corps. In addition to maintaining his own caseload, Mr. Solis's day-to-day work includes managing a team of Justice Fellows (attorneys) and Community Fellows (BIA Accredited Representatives) who work on defensive asylum claims, general removal defense, and other affirmative applications. Along with the rest of the IJC Legal Team, Mr. Solis is responsible for developing IJC's training curriculum for incoming fellows and for coordinating IJC's outreach efforts. Mr. Solis was previously employed by a private immigration law firm, and his practice included: removal defense, advising companies on employment-based visas, and helping families and individuals obtain immigration relief. During law school, Mr. Solis worked as an intern in the immigration unit of the HIV Law Project. He received his J.D. from the Benjamin N. Cardozo School of Law and his B.A. from St. Francis College. He is admitted to the New York Bar.
